Fraud charges withdrawn

On 11 August 2023 we appeared at Parramatta Local Court for a couple who were charged with fraud after they procured a third party to place dummy bids at the auction of their former home.

Negotiations resulted in the fraud charge being withdrawn by the prosecution on the basis that they would plead guilty to section 66(1)(c) of the Property Stock and Agents Act 2002. We submitted that this was the most apposite offence in light of the criminal conduct alleged.

The couple will get sentenced at a later date. The maximum penalty for the section 66(1)(c) offence is a fine. By comparison, the maximum penalty for fraud is ten years imprisonment.
